Social Security

If you believe that you are disabled and are no longer able to work, or if you know someone in that condition, Weissenstein Law Firm, LLC will provide assistance in trying to obtain Social Security Disability and/or supplemental security income (SSI) benefits. Our work effort will include meeting with the clients to obtain and provide information, obtaining medical records and possible witness statements, summarizing those medical records for the Court by preparing a Brief, appearing with the client at a hearing with the Administrative Law Judge, and advocating the client's position. If an adverse decision is rendered, we may assist the client in filing an appeal with the Social Security Appeal's Council. Estate Planning & Administration

South Carolina Law provides for the distribution of assets upon death in a manner that may be inconsistent with the individual's desires. Weissenstein Law Firm, LLC can assist the individual or a married couple in preparing his or her or their wills and estate plans so that the desires of the client can be accomplished. We have the experience to ask the questions that need to be asked to make sure that the client considers all aspects in the estate planning process. In addition, we help clients prepare powers of attorney and health care powers of attorney in order to provide services to protect the client who may later become incapacitated.

Weissenstein Law Firm, LLC practices before the Probate Court and will assist the client with the Probate process whether for estate administration or for appointment of Conservators and Guardians for incapacitated persons.

Litigation

Weissenstein Law Firm, LLC has experience with litigation in state and federal courts to help clients assert their legal rights. Paul Weissenstein has been appearing in Courts advocating for his clients since 1979, and has almost 35 years of courtroom jury and non-jury trial experience.

Some the types of trials that we have handled include real estate disputes including partitions of land and mortgage foreclosures, whether bringing a foreclosure for a lender or defending a foreclosure action for the debtor, and disputes regarding ownership of real estate. Weissenstein Law Firm, LLC has other litigation experience including issues involving contract disputes, personal injury, issues regarding inheritance from estates, and other matters.

Mr. Weissenstein is admitted to and has practiced in all South Carolina state courts, the United States District Court for the District of South Carolina, United States Bankruptcy Court for the District of South Carolina, the Court of Appeals for the Fourth Circuit, the Court of Appeals for the Federal Circuit, the Social Security Administration, and United States Tax Court. He has also assisted clients in dealing with various State agencies.

Mortgage Foreclosure

When the loan payments are not made, in order to collect the funds, it may be necessary to foreclose the mortgage that has been given as security for the loan. At Weissenstein Law Firm, LLC, we have over thirty years of experience in preparing, filing, and prosecuting mortgage foreclosure actions on behalf of various lenders.

Business Law

Weissenstein Law Firm, LLC can help clients establish corporate entities, LLCs, partnerships or joint ventures, including preparing and filing the appropriate documentation with various state agencies. In addition, we will help our clients prepare and/or negotiate contracts.

Title Examination and Insurance

Weissenstein Law Firm, LLC performs title examinations and provides title abstracts and title insurance for our clients. We have extensive real estate loan closing experience and have our own in house title abstractor. Mr. Weissenstein has been a title insurance agent since 1987 and is an agent for First American Title Insurance Company, one of the largest title insurance companies in the United States.

Special Referee

The South Carolina system of Courts mandates that some types of state court cases be referred from the Court of Common Pleas to the County Master in Equity who will serve as judge in the case. If the Master in Equity has a conflict (as having previously represented one or more of the parties) then the case is frequently referred to an attorney to serve as Special Referee. Based on the amount of experience that Paul Weissenstein has, especially regarding real estate matters, on many occasions Mr. Weissenstein has been asked to serve as the Special Referee to assist litigants in bringing legal matters to an appropriate conclusion.
